PRIVACY STATEMENT

At Language Dynamics Group, LLC. (“LDG”), user privacy is important to us. We want you to feel as comfortable as possible visiting languagedynamicsgroup.com and using LDG products. This Privacy Statement will tell you, as of the “Last Revised” date set forth at the end of this Statement, what information LDG collects, how we use that information, what choices you have concerning how such information is used and how we protect your information. We urge you to read our Privacy Statement so that you will understand both our commitment to you and your privacy, and how you can participate in that commitment. Please remember that any information (including personal and business information) that you post or otherwise reveal in a public forum (such as a bulletin board or product discussion forum) is not subject to this Privacy Policy and will be seen by third parties not related to LDG and may be used by them to contact you or for unauthorized purposes. Also, if you link to a third party site from a LDG Site, any information you reveal on that site is not subject to this Privacy Statement. You should consult the privacy policies of each site you visit.

PRIVACY POLICY

Business Information Collected by LDG

LDG collects the Business Information necessary to enable us to respond to your requests for our products and services and to send you information regarding our products and services from time to time.

Languagedynamicsgroup.com. When you visit languagedynamicsgroup.com, you may be asked to submit information such as e- mail address, company name, address and phone, and your product interest areas. This information is collected to help us process your requests for information.
Product Registration. You may be asked to complete registration form(s) on our site with contact information for use by LDG. Registration information may include your personal name, name of district, product purchased and other relevant information.
LDG. Upon registering and using the LDG service, we may collect various information (in addition to the information collected on the Order form) which includes IP Address, Browser, Connection Speed, Domain, Referring URL and other environment related information. This information is used to 1) provide a secure environment for the use of these services and 2) compute statistical information about the customers using these services in aggregate form. Where applicable, we also collect billing information to enable us to bill you for these services.
Newsletters. When you subscribe or sign up to receive LDG related newsletters published or offered by LDG, we will ask you for information necessary to enable us to process your request or to send you information regarding our products and services.

Disclosure of Your Business Information

Except as set forth in this paragraph, LDG will not disclose any Business Information to third parties unless we receive your prior permission. In the following limited circumstances we will consider, and may release, Business Information to third parties: (1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as protecting the rights, property or safety of LDG, our customers or others. We may also provide Business Information to our vendors, suppliers and business partners (“Partners”) where it is necessary in order for such Partner to (1) provide us with products and services related to better operation and maintenance of our Web site, (2) provide you with a product or service requested by you or (3) market products or services to you. LDG may provide information about you that does not allow you to be identified or contacted (“Aggregate Information”) to third parties. For example, we might inform third parties regarding the number of users of our site and the activities they conduct while on our site. Depending on the circumstances, we may or may not charge for this information. We may also use this information as part of products or services that we provide to third parties and to improve our products and services.

Student Assessment Data

Business Information collected by LDG as set forth above does not include student data entered in the course of using our products (“Student Data”). Except as specifically set forth herein, LDG will not access your Student Data nor will we disclose your Student Data to any third parties.

The LDG’s Web Service is hosted on servers that are co-located at a third party’s facilities. LDG will not access Student Data entered by you in the course of using the Service except in the following limited circumstances: (i) to provide you with technical support, solely at your request and with your permission; (ii) on a limited-access basis to install updates or produce regular backups. LDG will not provide your Web Service Student Data to any third party or permit any third party to access your Web Service Student Data, except by your permission or to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order. In addition, if at any time you decide to discontinue your use of the LDG Web Service, your LDG Web Student Data will be destroyed and removed from all servers according to the terms set forth in the LDG Web Service User License Agreement. You will be offered the option of receiving a copy of all such data prior to its destruction.

How LDG Protects Your Privacy Internally

LDG wants your business information to remain as secure as reasonably possible. We combine industry-standard technical safeguards with a code of conduct for those employees that are permitted to access our customers’ business information.

LDG Web Service is hosted on servers that are co-located at a third party facility, with whom we have a contract providing for enhanced security measures. For example, your LDG Web Service Student Data will be submitted via SSL encryption and stored on a separate server equipped with industry standard firewalls.. In addition, the hosting facility provides a 24 X 7 security system, camera surveillance, and locked cage areas.

On the employee side, every LDG employee is trained on our privacy and security procedures. Only authorized LDG employees, agents or independent contractors are permitted to access your Business Information or Student Data, and all such employees, agents or independent contractors must agree in writing to abide by our Privacy Statement. Those employees that violate our Privacy Statement are subject to disciplinary action, up to and including termination.

Despite these security measures, LDG does not represent or warrant that Business Information will be protected against loss, misuse, attacks, or alteration by third parties.

Your Privacy Choices

LDG E-Mail Promotions. Occasionally, we will send you e-mail communications to provide you with information or promotions relating to our products and services that may be of interest to you, including notification of important product updates. Each e-mail we send will contain instructions on how to unsubscribe in the event that you do not wish to receive any future e-mails. Please note that if you elect not to receive future e-mail communications, you will not receive notification of important product updates. However, even if you choose to opt out of receiving e-mail communications, we will still periodically communicate with you via mail and telephone.

Other LDG Communications (Non E-Mail). In addition, provided you are no longer using your LDG product or service you may contact and ask not to receive any future communications from LDG. However, if you elect not to receive these future communications, you will not receive any notification from LDG of important product updates in any form.

Correcting or Updating Your Personal Information and Contacting LDG Web Service by LDG.

You can always contact us in order to (i) correct or delete your Business Information in our systems; (ii) update the Business Information that you have provided to us; and (iii) change your preferences with respect to marketing contacts from LDG, by e-mailing us at [email protected]. Please also note that LDG may not be able to provide you with certain products and/or services once you are removed from its database.

LDG may change this Privacy Statement at any time by posting revisions to our Web site. Your use of the Site constitutes acceptance of the provisions of this Privacy Statement and your continued usage after such changes are posted constitutes acceptance of each revised Privacy Statement. If you do not agree to the terms of this Privacy Statement or any revised policy, please exit the site immediately.
